La Brasserie Le Tripick places great importance on personal data protection. We therefore take all necessary measures to protect the privacy of users (hereinafter “Users”) who visit and use the *** website (hereinafter the “Site”).

The following informs Users about the provisions governing the processing of personal data during any visit to or any use of the Site by the Users (hereinafter the “Personal data protection policy”).

1. General information

La Brasserie Le Tripick processes personal data belonging to the Users of the Site for the purposes and subject to the limits of the Personal data protection policy, during each visit or each use of the Site.

When processing personal data, La Brasserie Le Tripick shall comply with current laws and regulations, namely Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (hereinafter “the Regulation”).

In this respect, and pursuant to this Regulation, La Brasserie Le Tripick:

• will process the listed personal data for the purposes determined in Article 2, subject to the prior, free and express prior consent of the Users;
• process personal data in order to allow Users to use the Site for the necessary and legitimate purposes set out in Article 3 of the Personal data protection policy.

By accessing and using the Site, Users acknowledge that they have read and accepted this Personal data protection policy.

2. Personal data processing subject to prior User consent

By visiting or using the Site, for any reason whatsoever, the User expresses their free, individual, informed and unambiguous consent to expressly authorize La Brasserie Le Tripick to process personal data pursuant to the Regulation, within the limits of and for the purposes set out below and without prejudice to the data processing stipulated in Article 3.

The personal data provided by the User is kept in a file managed by La Brasserie Le Tripick and under its responsibility at all times, in accordance with Article 7.1.

2.1. La Brasserie Le Tripick processes the following personal data:

• Name, address, telephone number, email address, VAT number, total number of visits to the website, number of visits to each of the website’s pages, domain names of visitors’ Internet access providers, IP addresses;
• cookie data, in accordance with the Cookies Policy;
• any other information that may be exchanged between La Brasserie Le Tripick and the User, namely by email, during the User’s registration or use of the Site.
• the reproduction of images of groups or crowds during public demonstrations. It must be noted that by coming to La Brasserie le Tripick, you are at all times likely to be photographed to be put on our various medias (website, paper documents, social media, etc.). These are allowed without the authorization of the people, provided that they do not violate their privacy. 2.2. Data processing

Processing involves the collection, recording, storage, querying, organization, use and checking of personal data in accordance with Article 2.1.

2.3. Purposes of personal data processing

The personal data is collected and processed by La Brasserie Le Tripick for the following purposes:

• Advertising, commercial or marketing purposes

3. Processing of personal data where prior User consent is not required

La Brasserie Le Tripick shall also process the following personal data for the legitimate purposes set out below. This processing of personal data carried out by La Brasserie Le Tripick does not require the Users’ consent under Article 6.1.f) of the Regulation.

The personal data provided by the User is kept in a file managed by La Brasserie Le Tripick and under its responsibility at all times, in accordance with Article 7.1.

3.1. Nature of the processed data

La Brasserie Le Tripick processes the following personal data:

1. Name, address, telephone number, email address, VAT number, total number of visits to the website, + photo
2. any other information that may be exchanged between La Brasserie Le Tripick and the User, namely by email, during the User’s registration or use of the Site.

3.2. Data processing

Processing involves the collection, recording, storage, querying, organization, use and checking of personal data in accordance with Article 2.1.

3.3. Legitimate purposes of data processing

La Brasserie Le Tripick shall also process the personal data set out in Article 3.1. for the following legitimate purposes:

1. to carry out the reservation services offered by La Brasserie Le Tripick
2. for satisfaction surveys, statistical studies, trend analyses and market research in order to improve the services of Brasserie Le Tripick.

4. User rights

Users may exercise their rights to request that their personal data be rectified, to object to their data being processed and to limit it, in accordance with the conditions and within the limits set out below.

4.1. Right of access

Brasserie Le Tripick shall provide Users with the following information:

• the name and contact details of the data controller;
• the contact details for the data protection officer;
• the personal data processed;
• the purposes for which the personal data is being processed and the legal basis for this processing;
• the recipients or categories of recipients of the personal data, if applicable;
• where applicable, the fact that the data controller intends to transfer personal data to a country outside the European Union and the fact that the European Commission has (or has not) adopted an appropriate decision. If such a decision has not been adopted, La Brasserie Le Tripick transfers to the User the guarantees offered by the non-EU country and the resources in place for obtaining copies of the personal data;
• The option to object to the automated processing of their data, including profiling, unless there are justified grounds requiring La Brasserie Le Tripick to process this data, as well as the option to object to any processing of their personal data for marketing purposes.

1. Users have the right to request the information referred to in this article and in Articles 2.1 and 3.1.
2. Users can get a copy of the personal data processed. For every extra copy requested, La Brasserie Le Tripick reserves the right to claim payment for any expenses incurred in this new request. These costs will be calculated on the basis of the administrative fees incurred in connection with this request and will not exceed 20 euros.
3. Users will have the right to access the information, or a copy thereof, in a structured format, so that the personal data will be provided to them in a format that meets the technical standards in force when the access request is made. This format will therefore allow automatic readability.

4.2. Right to request rectification

La Brasserie Le Tripick guarantees and compels Users to update and rectify their personal data if this data becomes incorrect or incomplete.

4.3. Right of opposition to data processing

La Brasserie Le Tripick allows Users to object to their personal data being processed in full or in part on the following grounds:

• the data is inaccurate;
• the personal data processing is no longer required for the purpose for which they were collected;
• the User has withdrawn their consent;
• the data has been processed illegally.

In addition, La Brasserie Le Tripick allows Users to object to:

• the automatic processing of their data, unless there are justified grounds requiring La Brasserie Le Tripick to perform this processing;
• to the processing of their personal data for marketing purposes, including profiling where appropriate.

4.4. Right to be forgotten

La Brasserie Le Tripick also undertakes to respond to any request to erase personal data as soon as possible (right to be forgotten) when:

• the personal data processing is no longer required for the purpose for which they were collected;
• the User has withdrawn their consent;
• the data has been processed unlawfully or must be erased by virtue of a legal obligation;
• The User objects to the automatic processing of their data, such as profiling, and there are no justified grounds requiring La Brasserie Le Tripick to perform this processing.
• the User opposes the processing of their personal data for marketing purposes, including profiling where appropriate.

4.5. Right to restrict data processing

Users also have the right to restrict La Brasserie Le Tripick’s processing of their personal data when:

• the User believes the personal data to be inaccurate, whilst La Brasserie Le Tripick checks the accuracy of the information;
• the processing is unlawful and the User does not want their data to be erased, but requests the processing to be limited;
• the User objects to automatic processing, including profiling, or to the processing of their personal data for marketing purposes and it is necessary to verify the legitimacy of La Brasserie Le Tripick’s reasons for seeking to continue this processing;
• La Brasserie Le Tripick no longer requires the personal data processed but the data subject would like it to be held to establish, exercise or defend legal claims.

4.6. Transfer of data to a data controller

Users may transfer the personal data processed by La Brasserie Le Tripick to another data controller without objection from La Brasserie Le Tripick.

For such a transfer to be technically possible, Users may ask La Brasserie Le Tripick that it be performed directly by its data controller.

4.7. Terms and conditions

The rights granted to the User must be exercised in accordance with the terms and conditions described in Article 7.5. La Brasserie Le Tripick shall respond to such requests for information within one (1) month.

4.8. Notification

La Brasserie Le Tripick shall notify the User of any data that is erased or rectified in accordance with Article 4, unless such notification proves impossible or involves disproportionate efforts.

This notification will be sent by letter or email to the contact address / email address provided by the User.

5. Location, retention and retention period of personal data

La Brasserie Le Tripick retains Users’ personal data appropriately and securely in a form which enables it to be identified and made available.

The data is retained and hosted in Belgium. La Brasserie Le Tripick provides all of the required or useful security assurances with regard to current technical standards.

La Brasserie Le Tripick retains Users’ personal data for the purposes set out in Articles 2 and 3, for a period that does not exceed the time necessary to achieve the purpose of the processing, for all purposes governed by Articles 2 and 3.

6. La Brasserie Le Tripick’s responsibility – Data processing

6.1.

La Brasserie Le Tripick ensures that the processing of personal data is carried out in a lawful, loyal and transparent manner with regard to the User concerned. Any data processing operation performed by La Brasserie Le Tripick shall comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, and this Personal data protection policy.

La Brasserie Le Tripick will use all technical and organizational means to guarantee the confidentiality, integrity and accessibility of the personal data processed.

Where applicable, La Brasserie le Tripick and the Data Protection Officer will carry out an impact assessment when data processing is likely to present high risks for Users.

6.2.

Users’ personal data is not sent to any third parties other than partners of La Brasserie le Tripick, except in the following cases:

• The data transfer is required by law or regulation or has been ordered by an administrative or court authority;
• The data transfer is necessary to provide the services of the Site;
• The User has given their consent for the transfer.

La Brasserie le Tripick shall not be held liable for the processing of Users’ personal data by partners who supply their services in their own name and shall be liable for damage caused by processing personal data contrary to the Regulation.

Where the data is processed by a partner on behalf of La Brasserie le Tripick, the latter must provide sufficient guarantees that the appropriate technical and organizational means have been implemented and, more generally, that the Regulation has been respected. In particular, the data controller will have to comply with the Regulation and, therefore, keep track of processing activities.

7. Other

7.1. Retention of personal data

As a personal data controller, La Brasserie Le Tripick keeps a log of all its data processing activities. This log includes all information concerning the type of data processed, the Users concerned, the potential recipients of the data, the purposes of the data processing, the retention period of the data as well as a general description of the technical and organizational protection measures implemented.

This log is managed by La Brasserie Le Tripick and remains under its responsibility at all times. In addition to the aforementioned information, this log includes:

• a description of the purposes of the processing;
• a description of the categories of Users and the categories of personal data;
• the categories of recipients to whom the personal data have been or will be sent, including recipients outside EU countries or international organizations;
• the time limits for erasing different categories of data.

7.2. Entire agreement – updating of the Personal data protection policy

The Personal data protection policy covers all the contractual provisions binding the User, notwithstanding the legal provisions of the Site of which they are an integral part. The legal provisions of the Site will continue to apply for any point unrelated to the personal data of Users.

Furthermore, La Brasserie Le Tripick reserves the right to modify the Personal data protection policy. Once published on the Site, any update is binding on Users. La Brasserie le Tripick agrees to mention the date that the Personal data protection policy present on the Site was put online.

La Brasserie Le Tripick has also appointed a data protection officer (DPO), in accordance with Article 37 of the aforementioned Regulation. The DPO can be contacted by email at dpo@ardent-invest.com. The data controller and the DPO are required to ensure that La Brasserie Le Tripick’s processing of Users’ personal data is controlled and meets legal requirements.

7.5. Data protection authority

Under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, the User has the right to request additional information or file a complaint with the data protection authority
